The Supreme Court on Monday rejected the plea of convict Pawan Kumar Gupta, one of the four death row convicts in the 2012 Delhi Nirbhaya gangrape murder case.

Nirbhaya’s mother Asha Devi on Monday slammed the rapists for delaying the process of execution and said they must be,” hang one by one”.

Nirbhaya’s father Badrinath Singh, said,” The Supreme Court has the power to put an end to these tactics of convicts. Just to delay the process, they are filing petitions in the court”.

A bench comprising Justices R Banumathi, Ashok Bushan and AS Bopanna held that the same claim was earlier rejected by the Court after due consideration.

On July 9 last year, the apex court had dismissed the review pleas filed by the other three convicts – Mukesh, Pawan Gupta and Vinay Sharma in the Nirbhaya case, saying no grounds have been made out by them for review of the 2017 verdict.

APPLICATION ON BEHALF OF APPLICANT FOR WAIVER OF COST, FORMAT

Lawyer of Pawan Gupta, Advocate A. P. Singh claimed that according to the school documents (D. O. B. – October 8, 1996) he was a juvenile at the time of crime.

Pawan the death row convict said, “He was held major by a magistrate order passed in 2013. He argued that the order was passed without hearing him. He also argued that police had not produced the school documents in the case. No opportunity given to his council to examine the documents”.

The apex court said it found “no error” on the face of the main judgement requiring any review.

A Delhi court issued a fresh death warrants for February 1 against the four convicts – Vinay Sharma, Akshay Kumar Singh, Mukesh Kumar Singh and Pawan Gupta – in this case.
