MADRAS HC GRANTS INTERIM INJUNCTION RESTRAINING ONLINE SALE OF MEDICINES TILL NOVEMBER 9


The Madras High Court on Wednesday granted interim injunction restraining online sale of medicines till November 9.


Tamil Nadu Chemists & Druggists Association against online sale of medicines. The Association had recently moved a plea seeking a direction to authorities concerned to block links of websites that sell medicines online stating that although online shopping might be convenient to consumers, purchasing medicines through online.Madras High Court Considering this plea , Justice R Mahadevan granted interim injunction restraining the online sale of medicines till November 9. Thereafter, the court directed the Centre to file a counter and posted the matter for further hearing to November 9.


Moreover, laws for pharmacies in India are derived from Drugs and Cosmetics Act, 1940, Drugs and Cosmetics Rule, 1945 and Pharmacy Act, 1948.

The  TN C&D Association concluded, “Though various amendments have been made to the Act no provision has been made to utilize information technology for sale of medicines online.”
