  1. State of Jharkhand v. HSS Integrated SDN, S.L.P. No. 13117 of 2019

Arbitration and Conciliation Act, 1996 – Section 37 – the award passed by the Arbitral Tribunal can be interfered with in the proceedings under Sections 34 and 37 of Arbitration Act only in a case where the finding is perverse and/or contrary to the evidence and/or the same is against the public policy.

2. S.P. Misra v. Mohd. Laiquddin Khan, C.A. No. 3311 of 2015

Partnership Act, 1932 – Section 42 (c) – Privity of Contract – There cannot be any contract unilaterally without acceptance and agreement by the legal heirs of the deceased partner.

3. State of West Bengal v. Indrajit Kundu, JT 2019 (10) SC 397

Penal Code, 1860 – Section 306 read with Section 34 – Abetment of Suicide – addressed the victim as a call-girl – terming the deceased as a call-girl, there was no utterance which can be interpreted to be an act of instigating, goading or solicitation or insinuation, the deceased to commit suicide – Such material is not sufficient to proceed with the trial by framing charge of offence under Section 306/34 IPC.

4. Union of India v. Sri Harananda, M.A. No. 712 of 2019

Service Law – Recruitment – IPS Officer – Deputation – Clarification – No observations are made by this Court in the Judgment sought to be clarified with respect to right of the IPS Officers for deputation, in terms of the recruitment rules, if any, in the various CAPFs. Therefore, when the said controversy was not there, there is no question of any clarification as sought by the application.

Slums Areas (Improvement, Clearance and Redevelopment) Act, 1971 (Maharashtra) – Sections 3A, 4, 12, 36 – Powers, duties and functions of the Slum Rehabilitation Authority – Declaration of Slum Area – Clearance Order – Service of Notice – Held, There is no requirement of issuance of notice prior to the declaration under Section 3C.
