Delhi High Court dismisses petiton challenging Shahi Tharoor’s ‘Anticipatory Bail’ 


Oct 9 The Delhi High Court dismissed a plea seeking the cancellation of Shashi Tharoor's anticipatory bail granted by the Delhi session court in the case pertaining to the death of his wife, Sunanda Pushkar. 

Justice R K Gauba rejected the petition filed by lawyer Deepak Anand challenging the Congress MP Tharoor 'Anticipatory Bail'. 

The order came after the petitoner failed to convince the  court that his plea was maintainable  question asked by Court "show why should your plea be entertained".

Petitioner said the Anticipatory Bail application of the Shahi Thoroor's was premature and not maintainable since it was not in accordance with the provisions of the Code of Criminal Procedure (CrPC) and also in violation of the Law laid down by the Supreme Court.

Reply to Petitioner Tharoor advocate said that the petiton was not maintainable because Law has granted the Right to the accused to move it apprehending arrest and that the Sessions Court has the power to deal with it.





Senior advocate Vikas Pahwa, appeared for Tharoor. 

Senior standing counsel Rahul Mehra, appearing for the Delhi police, also opposed the maintainability of the plea, but said that there was "no reasonable apprehension" that Tharoor would be arrested if he was to appear before the magisterial court pursuant to the summons issued to him.
